Terms of Service

Who we are

Nation is run by Modern Grind Technology, a business of David Olverson, based in Virginia, United States. In these terms, “Nation”, “we” and “us” mean Modern Grind Technology; “you” means the person using Nation.

Nation is in an early, invite-only stage. Some features are marked Alpha, Testing or Coming soon on the site; those may change, reset their data or be removed.

Who can use Nation

• You must be at least 13 years old to create a Nation account.
• If you are under the age of majority where you live, you may use Nation only with the permission of a parent or guardian, who also agrees to these terms for you. Purchases by a minor need that adult’s permission.
• You may not use Nation if we have permanently banned you before.
• You must follow the laws that apply to you where you live.

Your account and invite-only access

• Access is currently by invitation. An invite or access code is personal: do not sell, trade or publish it. We may limit, pause or end invitations at any time, and an invite does not guarantee a place in any test, season or event.
• One person, one account. Do not share your account or let someone else play on it.
• Keep your password and your login name secret. Your login name is used only to sign in and is never shown publicly; your display name is what other players see.
• You are responsible for what happens on your account. If you think someone else has access to it, tell us through support right away.
• Give accurate information and keep it up to date.
• Nation staff will never ask for your password. Treat anyone who does as a scammer.

Fair play and acceptable use

You agree not to:

• cheat, including using mods, trainers, memory editors, macros, bots or any tool that gives an unfair advantage, or knowingly playing with someone who does;
• tamper with game results, box scores or the end-of-game uploads that record them, or send Nation data that did not come from a real game;
• fix, throw or arrange the outcome of a game, or boost an account’s stats or standing;
• harass, threaten, dox or abuse anyone, or post hateful, sexual or illegal content (the community rules give more detail);
• impersonate Nation staff, a moderator, a creator or another player;
• create or use another account to get around a sanction (ban evasion), or help someone else do so;
• attack, probe, overload or reverse engineer Nation’s servers, launcher or website, get around our security or rate limits, or access anything you were not given access to;
• sell, rent or transfer accounts, invites, access codes or items;
• use Nation to spam, scam or break the law.

Found a security problem? Report it privately through support. Please do not post it in a public channel.

Competitive results

• Where Nation supports it, match results and box score stats are recorded automatically from each player’s own game at the end of a game (the game’s end-of-game upload). Where those uploads are not available, the players in the match report the result, and if the uploads or the reports disagree, the match goes to staff.
• A report cannot be changed after it is sent. Reporting a false result is tampering.
• Staff may review, correct, void or remove a result, a stat line or a standing when there is evidence of cheating, tampering, a technical fault or a rules breach.
• If you think a result is wrong, tell us through support with the details. Once staff have reviewed it, their decision is final.
• Leaderboards, standings, seasons and their formats may change, and test data may be reset.

Sanctions and appeals

If you break these terms or the community rules, we may act on your account. Depending on what happened, that can include a warning, removing content, changing or resetting a display name or crew name, voiding results, a temporary suspension, a permanent ban, and removing access to the launcher, competitive play or the Discord. We may act on one account or on every account we reasonably believe belongs to the same person.

We keep a record of sanctions and of the staff actions behind them. You can appeal a sanction through support. A different staff member reviews the appeal where possible, and the outcome of the appeal is final. A sanction does not entitle you to a refund except as described in the Refund Policy or where the law requires.

Names and other content you create

• Display names, crew names, profile text, reports, tickets and anything else you submit stay yours. You give us a non-exclusive, worldwide, royalty-free licence to store, show and use them to run Nation (for example, showing your display name on a leaderboard or your crew name on a Passport).
• Names and content must follow the community rules: nothing offensive, misleading or impersonating, and nothing that infringes someone else’s rights.
• We may refuse, change or remove a name or any content that breaks these terms, without notice.
• If you send us ideas or feedback, we may use them without owing you anything.

Independent project and the game

Nation is an independent community project. It is not affiliated with, endorsed by or sponsored by 2K, Take-Two Interactive Software, the NBA or any team or player. NBA 2K and all related names, logos and trademarks belong to their respective owners and are used only to describe the game Nation works with.

Nation does not sell, give away or distribute the game. You must own your own legitimate copy of the game to play through Nation, and you remain bound by the game publisher’s own terms.

Digital purchases

• Nation may offer optional digital items, such as the Name Change Pass. They are a limited, personal, non-transferable licence to use a feature in Nation. They have no cash value and cannot be resold or exchanged for money.
• Payments are processed by Whop. Nation never receives or stores your card or bank details. Whop’s own terms also apply to the payment.
• Prices are shown before you pay. Taxes may be added where they apply.
• Refunds, chargebacks and what happens to an item afterwards are covered by the Refund Policy.

The launcher and our services

• We give you a personal, revocable, non-transferable licence to install and use the Nation launcher to access Nation. Do not copy, modify, sell or redistribute it.
• The launcher may update itself and may send us the technical information described in the Privacy Policy so we can run games and keep them fair.
• We may change, pause or stop any part of Nation, including during testing, and we may reset test data.
• Nation’s own name, logo, website and software belong to Modern Grind Technology. These terms do not give you any rights to them except the right to use Nation as described here.

Disclaimers

Nation is provided “as is” and “as available”. It is an early, invite-only service run by a small team, and it may be interrupted, contain bugs or lose data. To the fullest extent the law allows, we make no warranties of any kind, express or implied, including that Nation will be uninterrupted, error-free or fit for a particular purpose. Some places do not allow these exclusions, so some of them may not apply to you.

Limitation of liability

To the fullest extent the law allows, Modern Grind Technology and David Olverson are not liable for any indirect, incidental, special, consequential or punitive damages, or for lost profits, data, goodwill, rankings or in-game progress, arising from your use of Nation. Our total liability for any claim about Nation is limited to the greater of the amount you paid us in the 12 months before the claim and US $50.

Nothing in these terms limits liability that the law does not allow to be limited, or takes away rights you have as a consumer under the law where you live.

Ending your use of Nation

• You can stop using Nation at any time, and you can ask us to delete your account through support (see the Privacy Policy).
• We may suspend or close your account if you break these terms, if the law requires it, or if we stop running Nation. Where it is reasonable and safe to do so we will tell you why.
• The parts of these terms that by their nature should continue (such as content licences, disclaimers, limitation of liability and governing law) continue after your account ends.

Changes to these terms

We may update these terms as Nation changes. When we do, we change the effective date at the top of this page, and for significant changes we will also post a notice on the site or in the Nation Discord. If you keep using Nation after a change takes effect, you accept the updated terms. If you do not agree, stop using Nation and you can ask us to delete your account.

Governing law

These terms are governed by the laws of the Commonwealth of Virginia, United States, without regard to its conflict of laws rules. Any dispute that cannot be settled informally through support will be handled by the state or federal courts located in Virginia, and you and we agree to their jurisdiction, unless the law where you live gives you the right to bring a claim in your local courts.
